弁護士っていうのはですね、依頼人を保護するっていいますか、依頼された人の権益を守るのが役目ですよね。そうした場合、例えその弁護士個人が、依頼人の反対意見を持っていたとしても、その依頼人の権益を守んなきゃいけない立場にあると思います。それが役目だと思います。そうした場合、最初から交渉が始まった段階で弁護士を入れるっていうことは、非常に交渉だとかに角がたつって言いますかね、特に、あのう、何て言いますか、交渉っていうのは、やはり最終段階になったらお互いに譲歩するっていうのが、一つの解決方法であることは間違いないと思いますね。そうした場合、最後になって特に国際間の取り引きにおいては、言語も違いますし商慣習も異なるんで、紛争の解決だとかペナルティー条項だとか、そういった解決策をその契約書にもりこむ場合にですね、弁護士を起用するのが一般的ですけれども、最初から弁護士をたてて交渉にいどむっていうのは、決してよい方法ではないと思います。

As for lawyers, you could say, well, that their duty is to protect their clients or to guard the rights and interests of their clients. In that case—in that example—even if that individual lawyer has different views with those of his/her client, I think s/he is in a position in which s/he must guard the client’s rights and interests. I believe this is their duty. In this case, from the start, the first step in negotiations is getting the lawyer involved, and this is extremely—in negotiations and such—you could say harsh. Especially then, umm—how should I say this—in negotiations that when you reach the final phases, I think that one main way to reach an agreement is for both parties to yield to each other. In that case, when you come to the end, particularly in international dealings, the vocabulary is different and business customs differ, so the solution to a dispute or the penalty clauses and such are included in the contract. Generally, we appoint the lawyer [for this]; however, I think it is never good to challenge the lawyer in negotiations from the start.
